Amendments to the Regulations on Working Conditions of Female Employees in Night Shifts and Employing Workers in Shifts

Two separate regulations were amended in the Official Gazette dated 19 August 2017. As it is known, the Law No. 6645 (bag), which was published in the Official Gazette dated 23.04.2015 and entered into force, is the 69th article of the Labor Law. It made it possible to work more than 7.5 hours a night in tourism, private security and health services provided that the written consent of the worker is obtained, by making an exception to the provision in the article that limits the night work of workers to 7.5 hours. However, after this change, since the law and the regulation on the subject were different from each other, it could cause confusion in practice. This contradiction has been resolved and female employees working in workplaces where tourism, private security and health services are carried out will be able to work at night, provided that they give written consent beforehand, when the nature of their job requires night work. However, let’s add that night shift work in this way is limited to the specified sectors only and is not expandable by comment.

Another amendment made in the Official Gazette of the same date is for the shift system applied in shift-working workplaces;

The inconsistency between the legal regulation and the special regulation has been resolved as a result of the amendment made with the “Regulation on the Amendment of the Regulation on Special Procedures and Principles Regarding Working in Jobs Conducted by Employing Postal Workers”.

With this amendment, in addition to the harmonization of the law and the relevant regulation, it is seen that the expression “and in the works carried out by the subcontractor operating in the workplaces where these works are carried out” has been added differently from the text of the law. With this addition, it was aimed to prevent disputes that may arise regarding the narrow interpretation of the legal regulation within the scope of the “Interpretation Principle in favor of the Worker” of the Labor Law, and subcontractors and workers who undertook auxiliary work in the workplaces operating in the mentioned sectors were also included in the scope of the said regulation.

CHANGES IN THE REGULATION ON CONDITIONS

ARTICLE 1 – Article 5 of the Regulation on Working Conditions of Female Employees in Night Shifts published in the Official Gazette dated 24/7/2013 and numbered 28717 has been amended as follows.

ARTICLE 5 – (1) Female employees cannot be employed in night shifts for more than seven and a half hours. However, in the works where tourism, private security and health services are carried out, and in the works carried out by the subcontractor operating in the workplaces where these works are carried out, night work for more than seven and a half hours can be made, provided that the written consent of the female employee is obtained.

ARTICLE 2 – This Regulation enters into force on the date of its publication.

ARTICLE 3 – The provisions of this Regulation are executed by the Minister of Labor and Social Security.

ABOUT SPECIAL PROCEDURES AND PRINCIPLES REGARDING THE STUDIES

REGULATION

ARTICLE 1 – The following sentence has been added to subparagraph (a) of the first paragraph of Article 4 of the Regulation on Special Procedures and Principles Regarding the Works Conducted by Employing Employees by Mail, published in the Official Gazette dated 7/4/2004 and numbered 25426.

“However, in the works carried out by the subcontractor operating in the works where tourism, private security and health services are carried out, and in the workplaces where these works are carried out, the arrangement can be made as two posts in 24 hours.”

ARTICLE 2 – Article 7 of the same Regulation has been amended as follows.

Article 7 – In works carried out by employing workers in shifts, it is forbidden for workers to work for more than 7.5 hours in night shifts, except for the cases specified in the regulations stipulated in Articles 42 and 43 of the Law No. 4857 and Article 70. However, in the works where tourism, private security and health services are carried out, night work for more than seven and a half hours can be made, provided that the written consent of the worker is obtained. In the implementation of this paragraph;

a) Tourism services; In facilities that have been given a tourism operation certificate or a tourism investment certificate by the Ministry of Culture and Tourism in accordance with the relevant legislation, or an operation certificate has been given by the municipality to operate as a tourism enterprise,

b) Works in which private security service is carried out; Within the scope of the Law on Private Security Services dated 10/6/2004 and numbered 5188, in private security companies authorized by the Ministry of Interior or in any workplace as a private security guard,

c) Health services; Providing and/or producing health services; in the workplaces of real persons and public and private law legal entities and their unincorporated branches, in social service institutions defined in the Social Services Law No. 2828 dated 24/5/1983,

Covers the workers employed by the subcontractor in these workplaces.

The work of a post in which more than half of the working time coincides with the night period is considered night work.”

ARTICLE 3 – Article 12 of the same Regulation has been amended as follows.

Article 12 – The employer or employer’s representatives are obliged to keep the lists containing the names and surnames of the workers working at each post in the workplace in order to present them when requested by the Ministry, in the works carried out by employing workers in the mail.”

ARTICLE 4 – This Regulation enters into force on the date of its publication.

ARTICLE 5 – The provisions of this Regulation are executed by the Minister of Labor and Social Security.
